Yolanda is Head of our firm’s Spanish Desk.
She has over 17 years’ experience as a lawyer, spanning the UK and Spain and is registered as Spanish qualified lawyer (Abogado) with the Madrid Bar Association (Ilustre Colegio de Abogados de Madrid – ICAM) and as a Foreign Lawyer at the Solicitors Regulatory Authority.
Yolanda specialises in Anglo-Spanish law, providing legal tailored solutions for international clients on complex cross-border matters. With a strong cross-border focus, she advices private clients translating legal concepts and tax implications clearly and handling multi-jurisdictional matters working closely with notaries, tax advisors, accountants and executors in the UK and Spain.
Yolanda practiced in Spain for 6 years in a Madrid-based law firm, and featured in prestigious legal directories such as Chambers and Partners and The Legal 500. Prior to joining The Burnside Partnership, for 11 years she led the Spanish Department of a boutique law firm in the South-West of England.
Yolanda’s areas of specialism include:
- International Wills – advising British nationals and foreign citizens living in the UK on succession planning and implementing strategies that work across borders, considering the Spanish legal rules and tax obligations.
- Cross-border estates – dealing with the administration of Anglo-Spanish estates to transfer the ownership over the Spanish assets to the UK executors, trustees or beneficiaries under the applicable Will or intestacy rules.
- Legal opinions, certificates and affidavits of Spanish law – for the Courts in the UK, Probate Registry in England & Wales and the Sheriff Court in Scotland, protecting client’s interests and ensuring the documents meet formal requirements.
- Cross-border advice – assisting grantors (individuals and companies) in preparing Powers of Attorney in England and Spain to ensure powers granted in one country are recognised in the other, protecting their interests and avoiding delays or invalid decisions, together with liaising with the notaries in both jurisdictions.
- Corporate law, partnership agreements and employment advice – assisting UK corporate clients on incorporating companies and subsidiaries in Spain, preparing the necessary paperwork in the UK to enable a new legal entity to be incorporated in Spain and its directors are registered at the Spanish Companies House and Tax Office.
- Spanish property transaction – providing advice on buying and selling property in Spain, and preparing the contracts, ownership structures and tax obligations in Spain.
- Spanish visa, residency and taxes – assisting both private and corporate clients to ensure a residency application is processed promptly and efficiently, and advising on a range of tax issues specific to Spain including NIE/NIF application and registration.
- Family matters – including assisting on family and divorce cases where there are Anglo-Spanish elements such as different nationalities and or location of assets, different places of residencies or an overseas place of marriage.
